'EC Authorised to Declare Chandpur 1 Vacant'

In the ongoing tussle between the Election Commission and Awami League MP M K Alamgir, the commission chief has responded to the MP's comments in parliament made on Sunday.

He said that according to the parliament speaker, only the Election Commission had the authority to declare a constituency vacant.

"When we asked the speaker about declaring the Bhola-3 constituency vacant, he wrote that it was exclusively the Election Commission's jurisdiction," A T M Shamsul Huda told reporters in Narayanganj on Monday. He said the by-elections were held accordingly.

His comments came a day after Mahiuddin Khan Alamgir, elected from Chandpur-1, claimed in the parliament that the EC had 'abused its power' when it declared his constituency vacant.

However, Huda declined to elaborate citing that the matter was still pending at the court and it would not be right to speak on the matter.

The High Court stayed a gazette notification declaring Chandpur 1 vacant for six months.

The notification, dated Sep 22, was issued after the High Court declared MK Alamgir's candidature illegal. However, MK Alamgir, has recently been acquitted of his pending charges and will be free to contest the by-elections.

In the meantime the wife of his main rival, former education state minister Ehsanul Haque Milan, appealed to the court that Milan, currently in custody, be deemed elected.
