ACC set up following due process: DG PDF Print E-mail

As the controversy rages over its formation, the Anti-Corruption Commission Monday said it believes the government has set up the Commission following all the due processes, reports UNB.

It is quite normal for the relevant ministry to have all the documents relating to its appointment and the Commission believes those would be presented in time, if needed, said ACC director general (admin) Col Hanif Iqbal.

Hanif, also the Commission spokesperson, made the remarks at the regular briefing clarifying the ACC''s position about the controversy surrounding the constitution of the reconstituted Commission.

Former BNP lawmaker and parliamentary affairs adviser to ex- premier Khaleda Zia Salahuddin Quader Chowdhury Sunday filed a writ petition with the High Court challenging the locus standi of the ACC in suing him for corruption as he alleged that the ACC itself was constituted illegally. Hanif told the briefing that it is the responsibility of the government to follow the rules relating to the formation of the Commission.

"The present Commission was established by a notification issued at the order of the President." "According to our thoughts and belief, the government has established the Commission following all the processes," he said.

He, however, said the files and documents regarding the appointment of the Commission that are supposed to be with the ACC are indeed with it. "There is no scope for any doubt about it."

About the formation of the proposed Truth Commission, the ACC spokesperson said the anti-graft watchdog does not differ with the government in establishing a Truth Commission.

But, he said, the Commission finalized its recommendations proposing rearrangements of some clauses and sub-clauses of the proposed ordinance and by today it will send the recommendations to the appropriate authority.

Hanif would not elaborate what the Commission''s recommendations are. Responding to a question, he said the letter written to the National Board of Revenue (NBR) by the ACC is an advisory one and in the letter the NBR has been asked to look into whether the money legalised by people giving certain amount of taxes as they earned that legally and is consistent with their incomes.

Asked about the arrest of Dhaka City mayor Sadek Hossain Khoka, who was sued by the Commission on April 3, Hanif said nobody would be able to avert arrest when he or she would be required to be arrested. Asked why some, including former Prime Minister Khaleda Zia, have been arrested after filing of cases against them while some not being arrested even after filing of cases, he said he does not have answer to that.

Hanif, however, said there are many explanations of law, so are many explanations of situations. "Situations under which arrests are made are determined by the authorities and it is normal to have logic behind the decisions," he added.

About the inquiry into corruption allegations against employees of the Bangladesh mission in Abu Dhabi, he said the inquiry is at the final stage.
